Its one thing to pay for special order parts that are required to install (also depending on the part) but never pay for labor ahead of time. Thats why you get a quote on paper which it cant exceed and then you pay to pick up at completion. You should have not paid the shop $3K upfront!! And depending on your quote on paper, I wouldnt pay another dime. Second off you dont need a lawyer, just go to your local court house and sue the shop. Usually there is a filling fee depending what state you live in. Pay the filing fee, write the report, the shop/owner will get served with the papers and see the report why he is being sued. Then you go to court to present your case to the judge. If the defendant (the shop doesnt appear) you automatically win the case. If the shop shows up, you battle each other in front of the judge. He decides. Sometimes he will make you both come back a second time too see if you both have agreed to some terms, if not then he decides who gets what. Its that simple ;-] Dont waste your money on a lawyer.
